South Shuswap Zoning Amendment Bylaw No. 701-110

The owner of the subject property has made application to have a child care facility on the subject property in addition to the single family dwelling. Staff are proposing to create a new zone “P2 – Child Care Facility Zone” in South Shuswap Zoning Bylaw No. 701. The P2 zone is proposed to permit the uses Child Care Facility, Single Detached Dwelling, Secondary Dwelling Unit, Home Business, and Accessory Use.

CHILD CARE FACILITY means a building licensed as a community care facility in which care, supervision or any form of educational or social training not provided under the School Act is provided for any portion of the day to seven (7) or more children not forming part of the operator’s family. Care of less than seven (7) children is considered under home business regulations.

Public Hearing Not Required

This bylaw amendment proposal is consistent with the policies contained in Electoral Area C Official Community Plan Bylaw No. 725 (which also applies to Electoral Area G). Specifically, there are no amendments required to the Official Community Plan (OCP). 

Section 464(2) of the Local Government Act states that a local government is not required to hold a public hearing for a proposed zoning bylaw amendment if an official community plan is in effect for the area that is the subject of the zoning bylaw, and the bylaw is consistent with the official community plan. As this bylaw amendment is consistent with the OCP, a public hearing is not required to be held.

In accordance with Section 8.1.1 of Development Services Procedures Bylaw No. 4001-2, as amended, all owners of property within 100 m of the subject property must be sent notices advising that a public hearing is not being held and be given the opportunity to provide comment about the bylaw amendment. 

Where and when will the application be considered by the Board?

The application will be considered for third reading at the CSRD, 555 Harbourfront Drive NE, Salmon Arm, BC, during the Regular Board Meeting commencing at 9:30 AM on Thursday, June 20, 2024.  

The Regular Meeting will convene in the CSRD Boardroom with a combination of in-person and virtual attendance. There is no specific opportunity for the public to provide verbal or written submissions about this application at this meeting.
